1. Acceptance of Terms

By accessing or using OddPoll (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under the age of majority, you represent that you have permission from a parent or legal guardian.

3. Description of Service

OddPoll is an entertainment polling platform that presents new questions every three hours and displays real-time results. The Service is provided free of charge and supported by advertising.

We may modify, suspend, or discontinue all or part of the Service at any time without notice. We do not guarantee continuous availability or any specific uptime.

4. Voting & Results

Unless otherwise stated, each user may vote once per poll. Votes are anonymous and cannot be changed once submitted. Results are shown in real time as aggregate counts and may change as additional votes are received.

To help prevent duplicate voting, we use technical measures such as short cooldowns, rate limiting, and anonymous identifiers derived from device/user-agent signals. We do not store personal identifiers with your vote. See our Privacy Policy for details.

5. Acceptable Use

You agree not to, and not to allow others to:

  • Interfere with, disrupt, or degrade the Service or related networks.
  • Use automated means (bots, scripts, crawlers) to submit votes or access endpoints not intended for public use.
  • Circumvent rate limiting, security, or duplicate-vote protections.
  • Reverse engineer, decompile, or attempt to access non-public source code or data.
  • Use the Service for any unlawful purpose or in violation of applicable laws and regulations.

6. Privacy

Your use of the Service is subject to our Privacy Policy, which explains what data we collect, how we use it, and your choices. By using the Service, you consent to those practices.

7. Third-Party Services (Ads, Analytics, Push)

The Service may integrate third-party services such as advertising (e.g., Google AdSense), analytics (e.g., Google Tag Manager/Analytics), and web push notifications. Your use of those services is subject to the providers’ own terms and policies.

Advertising. Ads may be personalized or contextual depending on your settings and regional requirements. See our Privacy Policy for information about consent and controls.

Analytics. We use analytics to understand usage and improve the Service. Event tracking may include interactions like viewing or voting on polls.

Push Notifications. Enabling push notifications is optional and requires your explicit consent. You can disable notifications at any time via your browser or device settings.

8. PWA & Installable Experience

OddPoll may be available as an installable web app (PWA). The PWA experience depends on your browser and platform and may not be available in all regions or devices.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by OddPoll and protected by applicable intellectual property laws. All trademarks, logos, and service marks are the property of their respective owners.

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, OddPoll will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless OddPoll and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service (including blocking devices or identifiers) at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws applicable in our principal place of business, without regard to conflict-of-law principles. Where required by local law (e.g., consumer protection laws in the EU/EEA/UK), you may have additional rights.

Any disputes shall be resolved in the courts of the governing venue unless mandatory law provides otherwise.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Miscellaneous

  • Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.
  • No Waiver: Failure to enforce any provision is not a waiver of our right to do so later.
  • Entire Agreement: These Terms constitute the entire agreement between you and OddPoll regarding the Service.
